1. About the Terms

These purchase terms (“Terms”) apply to the purchase of sampling services for analysis (“tests”) that you make from [Babyscreen] (“babyscreen.se”). Purchasing a test includes both the test equipment and, when applicable, the analysis of your samples in a laboratory.

The agreement for purchase is made with BabyScreen Sweden AB, with organization number 559328-3418 and address Kyrkogatan 25, 411 15 Gothenburg (“us” or “we”). The Terms apply to you as a private individual.

If you use the Website to book an appointment with a clinic, you enter into a separate booking agreement with the respective clinic. The terms applicable to the clinic are provided in connection with the booking.

2. Orders and Prices

To make a purchase on the Website, you must accept the Terms. You must be at least 18 years old and otherwise legally capable of entering into agreements, for example, not under guardianship.

Once you have completed your purchase, we will send you an order confirmation as soon as possible via email. We recommend that you save the order confirmation to facilitate any future contacts with us.

We reserve the right to refuse an order, for example, if you have provided incorrect information or if the order cannot be fulfilled for any other reason.

At the time of order, the prices indicated on the Website apply. All prices include applicable VAT. Prices do not include any payment and shipping fees, which are stated separately.

If you order a test that requires laboratory analysis to provide a result, the cost of the analysis is included in the price stated on the Website.

If the price or information about a product indicated on the Website is incorrect and you knew or should have known this, the price or information will not apply to the purchase. In such cases, we will contact you as soon as possible.

3. User Instructions for Tests

For all tests, it is important that you follow the instructions provided with the package or stated at the time of registration. You are responsible for reading and performing the test according to the instructions applicable to the test you have ordered. Tests performed contrary to the instructions will not provide reliable results.

Depending on the test you conduct, the result may be displayed directly or require laboratory analysis. Whether the result is displayed immediately or if the samples need to be sent for analysis is indicated in the product description on the Website and in the instructions included in the package or provided at registration.

Tests where the result is displayed directly

Tests where the result is displayed directly must be performed according to the instructions included in the package.

Once you have performed the test, the test result will be displayed after the time and in the manner indicated in the instructions. For these tests, you do not need to send any samples back to us.

Tests that require laboratory analysis

For tests where samples must be sent for analysis, you need to activate the test and link it to the person who will perform it. You activate the test in our service in accordance with the instructions included in the package, in our app, or in your web browser. Our app can be downloaded via the App Store or Google Play. The test will not work if you do not activate it through our digital service. You will have access to the service in connection with the delivery of the test.

When you activate the test and register your personal information in the app or on the website, our User Terms for the service apply. We will also process your personal data in accordance with what is stated in our Privacy Policy.

Once you have activated the test, you perform it according to the instructions included in the package.

After performing the test, you must send the samples back to us. How to do this and where the samples should be sent depends on the test you have performed. Therefore, be sure to follow the instructions you receive in connection with the activation of the test and those included in the package.

The result will be sent to you after the time and in the manner indicated in the instructions.

4. Payment

Together with our payment service provider, we offer various payment options, and you choose how you want to pay for your purchase. The available payment options and any limitations as well as complete information about these are indicated on the Website and at checkout. Depending on the payment option you choose, additional costs may apply.

Payment is made via Klarna’s platform. Klarna’s payment terms apply for completing purchases.

5. Promotions, Discount Codes, and Other Offers

We may occasionally offer promotions, discount codes, gifts, and other offers (“Offers”). Such Offers are valid only during the time and under the conditions specified in connection with the Offer. Offers cannot be combined with other discounts unless explicitly stated on the Website.

For some Offers, you need to enter a code or activate the current Offer in another way before completing the purchase to take advantage of it. Otherwise, these Purchase Terms also apply to Offers.

6. Delivery

We deliver tests throughout Sweden, except for islands or other locations that do not have fixed bridge connections.

The delivery options we offer are indicated on the Website and at checkout, and the order will be delivered to you according to the delivery option you choose. Please note that restrictions on the various options may apply.

Shipping costs are added to the order unless otherwise expressly stated in connection with your order.

Delivery time may vary depending on the option you choose. The expected delivery time is indicated on the Website and will be shown to you during the ordering process and in your order confirmation. Please note that the indicated delivery times are approximate and deviations from these may occur. If your order is delayed, you will be notified of this.

If you have chosen to have your delivery to a pick-up location, you will receive a notification showing where and when your order can be picked up. You are responsible for picking up your order within the time specified in the notification. For unclaimed packages, we have the right to charge a fee corresponding to the administrative cost of handling unclaimed packages, amounting to SEK 250.

7. Right of Withdrawal

As a general rule, you have the right to withdraw your purchase within 14 days in accordance with applicable consumer protection legislation. However, you do not have the right to withdraw tests that can quickly deteriorate or become unusable. Which of our tests can quickly deteriorate or become unusable and therefore are not covered by the right of withdrawal is indicated on the Website. The fact that you cannot withdraw tests that can quickly deteriorate or become unusable means that you do not have the right to return them for a refund. If you notify us within 14 days of receiving the delivery that you or a person designated by you does not want to send your samples for laboratory analysis, you will, however, receive a refund of the cost for such analysis.

For purchases of other tests than those that can quickly deteriorate or become unusable, you do not have the right to withdraw if you have broken any seal on our tests. The reason for this is that all tests sold on the Website, for health and hygiene reasons, cannot be returned if the seal has been broken. If you wish to withdraw such a purchase and have not broken any seal, you have the right to withdraw your purchase by notifying us within 14 days from the day you or a person designated by you received the delivery.

If you wish to withdraw your purchase of a test covered by the right of withdrawal and you have not broken the seal, you must notify us by contacting us via email at info@babyscreen.se, by phone at +46 (0)10-1664270, or by mail to: Kyrkogatan 25, 411 15 Gothenburg, before the 14-day withdrawal period has expired. You can also choose to use the standard form for exercising the right of withdrawal provided by the Swedish Consumer Agency, see here.

When exercising the right of withdrawal, you must return the product to us without undue delay and in any case no later than 14 days from the day you notified us of your decision to withdraw.

When returning products covered by the right of withdrawal, you pay the cost of return shipping. We recommend that the product is sent in its original packaging and well packaged with a trackable shipment.

If you withdraw your purchase, we will refund what you have paid for the test including delivery costs (but this does not include extra delivery costs due to you choosing a delivery method other than the cheapest standard delivery we offer and the return shipping cost incurred when exercising the right of withdrawal). From the amount to be refunded, we have the right to deduct an amount corresponding to the decrease in the product’s value compared to the product’s original value. This only applies if and to the extent such decrease in value is due to your handling of the product beyond what is necessary to establish its nature or function.

The refund will be made without undue delay and in any case no later than 14 days from the day we received your notification of withdrawal. However, we may withhold the refund until we have received the product back from you or until you have provided proof that you have returned the product, whichever occurs first. Refunds are made via the payment method you chose at the time of ordering on the Website unless we have explicitly agreed otherwise. In any case, the refund will not cost you anything.

8. Complaints

You have the right to complain about the test in accordance with mandatory consumer protection legislation. This means you have the right to complain for three years. To make your complaint effectively, we recommend that you contact us via email at info@babyscreen.se, by phone at +46 (0)10-1664270, or by mail to: Kyrkogatan 25, 411 15 Gothenburg. If you wish to complain, you should contact us as soon as possible after discovering the defect. In the case of a valid complaint, we will compensate you according to the applicable law.

Delayed test results or retesting of a sample are not considered valid complaints. No financial compensation is given for delays of fewer than 10 working days, i.e., 20 working days from the time of sampling. For delays of more than 10 working days, financial compensation of 50% of the service’s purchase price is provided. If a sample is not analyzable after retesting, a new sample should be requested. If the patient opts out of a new sampling, they are entitled to financial compensation equivalent to 100% of the purchase price. If they instead choose to submit a new sample and the new sample can be analyzed, they are entitled to financial compensation equivalent to 50% of the purchase price.

Retesting of samples that have not passed the laboratory’s quality control, e.g., in cases of hemolysis, high blood fat content, high bilirubin levels, abnormal DNA concentration, or other comparable deviations, is not covered by the right to complaint. If a new sample needs to be provided or if the analysis results cannot be provided, no financial compensation will be made.

By purchasing, I understand that all medical analyses can yield false positive or false negative results. In the event of an incorrect result, Babyscreen is not obligated to provide any financial compensation.

9. Product Information etc.

We reserve the right for out-of-stock products and any image or typographical errors on the Website, in advertisements, or other marketing materials, as well as product descriptions. We have the right to correct such errors, change or update the information on the Website, and to continuously make product changes and improvements on the Website.

Images showing tests on the Website, in advertisements, and other marketing materials should be considered as illustrations only and not as specifications of their properties, functions, origin, or as a guarantee. Always refer to the instructions included in the package for your test.

The Website and all its contents are owned by BabyScreen or, where applicable, by our licensors. The information on the Website is protected by, among other things, intellectual property law. This means that you may not copy or use trademarks, company names, product names, images and graphics, design, layout, and information about products and other content without our prior written approval.

10. Force Majeure

If we are unable to fulfill our obligations to you or if the performance of our obligations is significantly impeded due to circumstances beyond our control, such as war and natural disasters, we have no obligation to fulfill our obligations during the period these circumstances persist. However, you always have the right to exercise your rights under mandatory consumer protection legislation.

11. Changes and Transfers

We may change these Terms at any time, but the purchase terms you accepted at the time of your purchase will always apply to that purchase. All changes will be indicated in the latest published version of the Terms on the Website. The new terms will apply to you when you have accepted the Terms, that is, in connection with making a new purchase on the Website.

We have the right to assign all or part of our rights and obligations to a third party without your prior consent.

12. Applicable Law and Disputes

These Terms shall be interpreted and applied in accordance with Swedish law.

You also have the right to contact the National Board for Consumer Disputes (ARN) via arn.se or by mail to Box 174, 101 23 Stockholm. In the event of a dispute, we follow ARN’s recommendations. As a consumer, you also have the option to complain via the EU’s online dispute resolution platform, which you can access via http://ec.europa.eu/consumers/odr.

Regardless of the above, any disputes can also be resolved in any competent court.
